Effective 27 October 2017, the new Fair Work Amendment (Protecting Vulnerable Workers) Act 2017 amends the Fair Work Act 2009 (“Fair Work Act”) to impose obligations on responsible franchisor entities in relation to contraventions of civil remedy provisions by franchisee entities and on holding companies in relation to certain contraventions by subsidiaries.

The amendment also vests increased evidence gathering powers on the Fair Work Ombudsman to allow it to more diligently investigate breaches of workplace laws.  These powers are similar to those available to corporate regulators such as ASIC and the ACCC.
